Terms of Use — Tire Size API & Data Services

1. Acceptance of Terms

By accessing or using any service, product, platform, orapplication offered by Virtual Dimension ("Company," "we,""us," or "our"), including but not limited to our DataServices, Analytics Services, Web Development, Cloud Services, CustomApplication Development, Marketing Services, and the Tire Size API(collectively, the "Services"), you agree to be bound by these Termsof Use ("Terms"). If you do not agree to these Terms, you may not useany of our Services. These Terms constitute a legally binding agreement betweenyou ("User" or "you") and Virtual Dimension.

2. Services Provided

Virtual Dimension offers a range of technology and dataservices to businesses and developers. Our Services include, but are notlimited to:

2.1 Data Services

Comprehensive data collection, integration, processing, andmanagement solutions to help organizations maximize the value of their dataassets.

2.2 Data Analytics

Advanced analytics, reporting, and business intelligence toolsthat transform raw data into strategic insights to support informeddecision-making.

2.3 Data Communication & Dashboards

Interactive, bespoke dashboards and data visualizationsolutions that present complex data in clear, actionable formats. Includessecure and reliable data transmission infrastructure across your systems.

2.4 Web Development

Design and development of secure, scalable, and responsivewebsites and web applications tailored to your business objectives, fromstraightforward pages to complex platforms.

2.5 Cloud Services

Cloud infrastructure setup, management, and optimizationservices to support scalable and reliable operations for your business.

2.6 Custom Application Development

End-to-end development of custom software applications designed to meet your specific business requirements, from concept throughdeployment and ongoing support.

2.7 Marketing Services

Digital marketing solutions including user targeting,advertisement management, and product utilization analytics to help grow yourbusiness.

2.8 Tire Size API

Programmatic access to tire size data, vehicle fitment specifications, and related automotive information through our REST API endpoints, intended for developers in automotive, e-commerce, and fleetmanagement sectors. This includes:

• Tire size specifications and dimensions

• Vehicle fitment and compatibility information

• OEM tire size strings and their component dimensions (width, aspect ratio, rim diameter)

• Search by vehicle (make, model, year, trim), by tire size, and by VIN

All Services are provided "as is" and we reserve theright to modify, update, or discontinue any feature or Service at any time.Where feasible, we will provide reasonable advance notice of material changes.

3. User Responsibilities

Regardless of which Service you use, you agree to:

• Use the Services only for lawful purposes and in accordance with these Terms

• Maintain the confidentiality of your account credentials, API keys, and any access tokens

• Not exceed the usage quotas, ratelimits, or scope specified in your service plan or agreement

• Not attempt to reverse engineer, copy, modify, or create derivative works of any Service

• Not use the Services to transmitharmful, unlawful, or unauthorized content

• Comply with all applicable lawsand regulations in your jurisdiction

• Provide accurate information whenregistering an account or entering into a service agreement

• Not resell, sublicense, orredistribute access to any Service without prior written consent from VirtualDimension

4. Service Plans and Access Tiers

Certain Services, including the Tire Size API, are offered under tiered access plans. The terms applicable to each tier are as follows:

The Tire Size API is offered on exactly four plans: Free, Starter, Pro, and Business.

4.1 Free Plan

Free access is provided for development, evaluation, and low-volume use. Free plan access is subject to strict usage limits (e.g., 300 requests/day and 100 requests/hour for the Tire Size API). We reserve the right to modify, restrict, or revoke free plan access at any time without notice. Free plan access does not include technical support.

4.2 Paid Plans

Paid plans (Starter, Pro, and Business, and any equivalents for other Services) are governed by the pricing and limits published on our website at the time of subscription. Paid plan users receive support as described in their plan. Rate limits and usage quotas vary by plan and are detailed on the applicable pricing page.

In addition to daily request limits, certain endpoints are subject to per-endpoint monthly usage quotas, and certain endpoints are available only on specific plans. Current limits, quotas, and plan availability are published in our API documentation and are returned by the API itself via usage response headers and the account usage endpoint.

4.3 Custom & Contracted Service Agreements

For clients engaging Virtual Dimension for web development, custom application development, cloud services, or marketing services, specificdeliverables, timelines, pricing, and support terms will be outlined in a separate Statement of Work or service agreement, which supplements these Terms.

5. Service Availability

While we strive to maintain high availability across all Services, we do not guarantee uninterrupted access. Downtime may occur due to:

• Scheduled maintenance windows

• Unplanned technical outages

• Service degradation during peakusage periods

• Third-party infrastructure issuesbeyond our control

We will make reasonable efforts to provide advance notice ofscheduled maintenance. We are not liable for any damages resulting from serviceinterruptions.

6. Data Security

We implement industry-standard security measures to protectyour data and communications across all our Services. However, you acknowledgethat:

• No system is completely secure

• You are responsible for securingyour own account credentials and API keys

• Data transmission over theinternet carries inherent risks

• You should implement appropriatesecurity measures within your own applications and systems

We will notify you of any security breaches that may affectyour data in accordance with applicable laws.

7. Intellectual Property

All intellectual property rights in our Services — including software, databases, data sets, content, dashboards, APIs, and documentation —remain the exclusive property of Virtual Dimension or our licensors. You aregranted a limited, non-exclusive, non-transferable license to use theapplicable Service solely as permitted by these Terms and your service plan.

You may not:

• Copy, modify, or distribute ourproprietary content, data, or software

• Use our trademarks, branding, orlogos without prior written permission

• Claim ownership of any part of ourServices or outputs

• Use our data or API responses tobuild a competing service or database

7.1 Prohibited Bulk Extraction & Dataset Rebuilding (Tire Size API)

The tire size and vehicle fitment data, and the relationships between them (including which tire sizes fit which vehicles), are proprietary databases owned by Virtual Dimension. In addition to the restrictions above, and regardless of your access tier, you may not:

• Use the API to systematically harvest, scrape, crawl, bulk-download, or otherwise extract all or a substantial portion of the underlying data, including by enumerating or iterating across endpoints (for example, sweeping the reverse-lookup, by-vehicle, or size endpoints) to assemble a copy of our dataset

• Reconstruct, replicate, or derive all or a substantial portion of our tire-size or fitment database from API responses, whether directly or in aggregate over time or across multiple accounts, keys, or IP addresses

• Store or retain API responses beyond what is reasonably necessary to operate your own application, or redistribute, resell, or publish the data as a standalone dataset

• Circumvent or attempt to circumvent rate limits, per-endpoint usage quotas, authentication, or other technical access controls

• Access the fitment endpoints (including the reverse-lookup, by-vehicle, and size lookups) other than in response to genuine, human-initiated end-user activity within your own application — for example, via robots, crawlers, spiders, headless browsers, scripts, or scheduled jobs that iterate across vehicles or sizes

• Continue to access the Services after we have throttled, suspended, or terminated your access, including by creating or using additional accounts, API keys, or IP addresses to evade an enforcement action; each such attempt is a separate and continuing breach of these Terms

If you have a legitimate need for bulk or full-catalog data to power your own application, contact us about a commercial data license — we're happy to help you access the data the right way.

We monitor for automated enumeration and abnormal access patterns. We reserve the right to throttle, suspend, or terminate access — without refund — where we reasonably believe these restrictions have been breached. This section survives termination.

8. Payment and Billing

For all paid Services, the following billing terms apply:

• Fees are charged according to yourselected plan or agreed service contract

• Subscription payments (e.g., APIplans) are due in advance on a monthly or annual basis

• Project-based services (e.g., webdevelopment, custom apps) are billed per the agreed payment schedule in theapplicable Statement of Work

• All fees are in Canadian dollarsunless otherwise stated

• All fees are non-refundable unlessotherwise specified in writing

• We may update pricing with 30days' written notice

• Accounts may be suspended fornon-payment

• You are responsible for allapplicable taxes related to your use of our Services

9. Limitation of Liability

To the maximum extent permitted by law:

• Services are provided "asis" without warranties of any kind

• We disclaim all warranties,express or implied, including merchantability and fitness for a particularpurpose

• We do not warrant the accuracy,completeness, or fitness of any data provided through our Services, includingtire fitment data, for any specific application or vehicle

• Our total liability shall notexceed the amount paid by you for the applicable Service in the 12 monthspreceding the claim

• We are not liable for indirect,incidental, special, consequential, or punitive damages

• We are not responsible for damagescaused by your misuse of any Service or failure to comply with these Terms

10. Termination

Either party may terminate access to any Service under thefollowing conditions:

• You may terminate a subscriptionby canceling your account through the applicable account portal

• For project-based services,termination terms are governed by the applicable Statement of Work

• We may terminate or suspend youraccess immediately if you breach these Terms

• We may terminate any Service with30 days' written notice for convenience

Upon termination, your right to use the applicable Serviceceases immediately. Provisions regarding intellectual property, limitation ofliability, and governing law survive termination.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. Whenwe make changes:

• We will post the updated Terms onour website at vdim.app/terms-of-use

• We will notify you of materialchanges via email or through the applicable Service

• Your continued use of any Serviceafter changes constitutes your acceptance of the updated Terms

• If you do not agree to the updatedTerms, you must discontinue use of the affected Service

12. Governing Law

These Terms are governed by and construed in accordance withthe laws of Canada, without regard to conflict of law principles. Any disputesarising from these Terms or your use of our Services shall be resolvedexclusively in the courts of Canada.
